| As far as we can tell, she's neither black, Hispanic, nor Muslim, so this will be mostly swept under the rug like all the other things. Nothing to see here we haven't seen dozens of times with barely a nod. I'd contest the charges, and if the judge throws them out, then slam the school and teacher with lawsuits for malicious prosecution, and maybe a few other things - the suspension is extreme enough to warrant one or two charges itself. Unfortunately, I'm seeing some indication that Virginia's overly broad in its definitions for criminal battery. But seriously, if that were enough to get someone suspended for a month, I'd have been able to go through half my high school classes with no classmates! I had one instance where I was hit by over 300 flying objects in a single period. My god. Imagine the charges I could have levied! The lives I could have destroyed! |

In tort (lawsuit) law, any unwanted physical contact, including thrown objects, constitutes battery. The anticipation of such contact constitutes assault. As such, very few instances are worth going to court over unless the assault/battery directly or indirectly causes actual (significant) physical injury or property damage. Usually, criminal law holds a higher standard. However, some states keep that standard very low - to the extent that so much as spitting at someone or throwing *any* object, even a harmless one, is assault and/or battery. Others will essentially require visible injury. And on the extreme end, the injury might need to require medical attention to qualify. If the state has a low threshold, and the victim presses charges, it has to be prosecuted. So, we're back to the teacher and/or administration needing to be summarily terminated and stripped of any and all teaching-related credentials. After all, they're clearly unqualified to deal with minors if this is how they handle this kind of situation. |
