We sure know derivative works (even doujinshi) are not being prosecuted. Maybe the creators just never complain, because that's traditional.

If you mean for sale. Then I think it's the same as people making and selling fanart at anime cons and such over here. It's probably a grey area over there too

That is rather because the doujinshis can attract people to the original show, which is a win win situation.

It's unreasonable to assume that executives are capable of thinking that far. At least in America they mostly can't, and keep using the laws against fan translators.

Not really, you are free to make those kind of thing even tho it's clearly a copyright infringement.

Maybe it's been going for a long time and has become a cultural thing that they didn't want to make a big fuss over it after all this time.

Also, it allows non-premium members to search for loli.
On the bad side, gelbooru isn't as well-tagged, and picture quality often suffers. But pixiv is way worse on both parameters.

Doujins are just unofficial fanworks, so no. I think technically it's kind of a grey zone but no one really cares. Official works would be a different story

That being said, even unofficial works can not portray the original work in a negative light or they might face charges

The main organizers of dojinshi markets answered this question with Japanese-like phrase, anmoku no ryokai, which literally means "unspoken, implicit agreement." Needless to say, publishers never encourage dojin artists to violate their copyrights. But they gave the creators their tacit permit. Pink explains that this anmoku no ryokai is an imperfect but calcurated business model of manga publishers in Japan. He articulated it in three ways. First, the dosinshi devotees are good manga's customers. Second, dojin creators are the huge pool of potential talent. Third, by observing the trend of dojinshi market, they can predict the direction of professional manga market.
