Japan redefines rape and raises age of consent in landmark move

Japan has passed laws that redefine rape and raise the age of consent in a landmark overhaul of sex crime laws.

The definition of rape was broadened to "non-consensual sexual intercourse" from "forcible sexual intercourse", aligning Japanese law's definition with other countries.

The legal age of consent, previously at only 13, has been raised to 16 years.

Previous laws did not protect those coerced into having sex and deterred reporting of such attacks, critics say.

The new laws were passed by the upper house of the Diet - Japan's parliament - on Friday. They explicitly outline eight scenarios where it is difficult for a victim to "form, express, or fulfil an intention not to consent" to sexual intercourse.

These include situations where the victim is intoxicated with alcohol or drugs; or subject to violence or threats; or is "frightened or astonished". Another scenario appears to describe an abuse of power, where the victim is "worried" of the consequences of refusal.

This is only the first time Japan has changed its age of consent since its enactment in 1907.

The changes also ban "photo voyeurism" which includes upskirting and secret filming of sexual acts, among other things.

But some activists have told the BBC that these legal reforms address only one part of the problem.

Survivors of sexual assault who go public also often receive threats and nasty comments online.

Even if the reforms are enacted, survivors must feel empowered to report their attacks, activists say.

In Japan, survivors of sexual violence are often reluctant to come forward because of stigma and shame. A 2021 survey by the government showed that only about 6 per cent of women and men reported an assault half of the women polled felt they couldn't do so because of "embarrassment".

Seems good because it looks like it was legal to rape an unconscious woman.

That's not being woke, that's being normal.
Woke is making asking a woman out to be sexual assault and other nuttiness like that.

I don't think it will reduce any incidents of sex crimes and they will be driven underground even more than never before. Papakatsu (パパ活, older men finding younger girls and vice versa) is still going strong, unfortunately.

We're talking about East Asia (minus China) where fixing laws don't do much.

Casual Reminder that the 13 age of consent ONLY happens on an Island that's actually illegal to be on.

Most States in Japan have it similar to the USA where it's 16 to 18.

There is a difference in the terminologies application when referring to hobbies, and referring to laws and policies.
If you see an anime fan refer to SJW or "woke" things, most of the time it refers to a sort of virtue signalling in media.
With policies and law it's a lot different. Even your most devout anti-sjw wants some level of accountability for things such as rape.

When it comes to any law what matters is not just the thought behind a law but how the laws are actually written. Without knowing full details I can't really comment beyond broad statements. It's very important to properly differentiate different acts and motives and severity so they can all have reasonable legal responses and not to equate them as all the same act. If this isn't done it creates more victims for many reasons. It makes people less likely to report the less severe crimes because they feel the punishment is too harsh, it potentially makes people more likely to downplay more seriously bad acts due to them being lumped with morally ambiguous acts, and can lead to the creation of a culture of secrecy due the taboo nature of sexual relations which leads to abuse because abuse can more easily happen in secrecy of relations. Then on top of that Japan already has a serious problem with their judicial system where people accused of a crime are treated as guilty until proven innocent if they weren't already coerced into a false confession before they even get a chance and that would be even worse if they include more ambiguous or hard to (dis)prove acts in law such as not properly distinguishing level of intoxication during sexual contact. Maybe victims would come forward more if the police werent so corrupt so when there is a guilty verdict people actually should have a good reason to trust it's more likely the case true than not.

Also worth noting the BBC while normally a relatively reliable source has this weird hatred for Japanese people writing commentary article after article on how awful they think the Japanese are. I don't trust them talking about Japan.

Yeah, I was about to say that. If they actually cared about their citizens they would not be wasting energy on writing that law but instead mandate proper sex education in Japanese schools or some other means of informing the public. Ive heard they are even worse than Southern red states in the US when it comes to that. Japanese youths are ridiculously ignorant about sex from what I recall seeing some time ago I think it was on NHK World. That would do far better things for people there.
