It's fair use. If it were being sold then it would be an issue even those for piracy object to fangames and hacks being sold.

No sorry that doesn't work when you are trying to steal assets and names exactly why I support Nintendo in these.

It's not fair use. If you really think that then I suggest you learn about copyright law. Fair use allows for a person to use a portion of the work (not the majority of the work) in order to critique, review, or parody.

This product may not be sold for money, but it IS being sold for fame and is detracting attention from the product of the actual holder of the IP which may impact sales at this date or at a future date, as well as impact their image.

To be clear, this is not a debate. You can romhack as much as you want so long as you do it on your own, but as soon as you release it to the public, then it becomes copyright infringement. Before Commander Keen was made, which was before Doom, the creators had created a copy of Mario but on PC, this was alright as it remained in their circle and they had not released it to the public. As soon as you do such a thing, the amount of usage of copyrighted material automatically makes it copyright infringement. There is room for debate when a small amount is used, but this isn't even close to that.
