This is my understanding: it isn't the torrent file that's the problem so much as whether the content is copyrighted or not. The site sends out links to torrents for ongoing shows that haven't been licensed yet. Mailing is okay because it's a one-time thing, but if you linked to a torrent on the forums and it later becomes licensed, now the site is directly linking people to copyrighted content. So the logical solution is to just restrict people from posting torrent links period.

Linking to a site, like a fansubber's page, is different. You aren't sending someone directly to a download, so thanks to the disclaimer about third-party sites MAL isn't responsible for the content they may or may not provide.

That's my take on things, at least. It's all about covering your ass.

The terms aren't really all that special, either. I read over them and it's all just copy/paste from the usual bland TOS. >_>;;

Couldn't it be like.. something original to this site?

Well, they basically cover most (many) of the issues that I have been worried about for a while. I'm sure it'll evolve over time.

The point isn't so much original as to be thorough and cover all your bases. If some of the text can be copied and adapted, Xinil has that much more time to make more enjoyable additions to the site.

Probably some sort of copyright infringement suit, but there are quite a few legal issues you could potentially run into in managing a decent-sized site on the net even without worrying about American anime distributors trying to gain some control over fansubbing and such.

It's a legal thing. I don't guess you've ever heard of COPPA? The other option besides disallowing children under 13 is setting up some sort of parental consent form that has to be signed and returned via fax or mail or something of the sort, which would be a huge pain in the ass. Obviously kids can still use the site by lying about their age, but that absolves Xinil and co. of responsibility in court.

Yeah, I've heard of it and that's how most other forums actually do it and how kids get around it. Of course, people of any age could be as naive/ignorant/immature/vulnerable as they wish but I guess it's inevitable that a line would have to be drawn somewhere even if it's just for convenience.

It's not so much a matter of ignorance or maturity as protecting their privacy and such - the law is there to restrict sites gathering personal data (even if it's just an email address and such) from children. I guess they figure teenagers are old enough to fend for themselves.
