A bit more details on the rules:

In regards to formerly licensed manga by defunct or former licencors... Anime licenses are usually five years (confirmed), with renewal time before the ending period. Five years for manga is too much as it is hard to say if any manga will even last that long, so I have made the assumption of three years (irrespective of whether it is 1-volume or 100-volumes). Tokyopop officially closed their North American branch in 2011, so if we assume they renewed the license for any of their manga in the same year, those will last until 2014. Following 2015, the license is no longer owned by any person unless the license has been transferred to another company or renewed. Always read Anime News Network and the former licensor's website, in this case, Tokyopop, for more information about this subject.

The three months (give or take) leniency I have added as a rule is a sort of buffer period for fans to know that the scanlation is possibly being worked on and also so that it does not displease current scan groups. Many scan groups today, especially small groups that work on specific genre of content or a very limited number of projects, get very annoyed when another group or individual decide to barge in into their projects without any disregard to the effort they have put in or are putting in. Without knowing they can help, these new groups tend to make the previous group disband/exit from the scene and sadly some (of the new groups) even say their farewell after a short stint - which is counter productive to the goal of this club. *Unless you have an active team available on a particular day of the week that are able to dedicate a few hours (such as MangaStream), scanlating any manga is quite challenging. And depending on how experienced an individual is, tasks can take from a few hours to weeks for a single chapter.
